ATC Says They’re Cracking Down on CBD Oil Sales in Louisiana

There's a lot of confusion when it comes to the legal and not-so-legal derivatives of marijuana and its non-psychoactive cousin, Hemp.  So much so, that stores around the country selling CBD Oil (which is supposed to contain less than 1% of the high-causing chemical THC) often find themselves in the cross hairs of authorities who consider the substance patently illegal.

The crux of the matter is the fact that the Agriculture Act of 2018 specifically legalizes the oil if it has less than .3% THC.  On Friday, the Louisiana Office of Alcohol and Tobacco Control (ATC) made it clear that the state law that makes it illegal to sell this product would be enforced regardless of the Federal position on these matters.  According to the report from Big Easy Magazine, the ATC is currently waiting on guidance from the Louisiana Attorney General’s office on the conflict between state and federal law.  Until then, the ATC will be cracking down on businesses that are found to be in violation.

CBD oil is sold over the counter without a prescription to treat a variety of issues including depression, anxiety, joint pain, swelling, and more in states where it is legal.  Currently, the Louisiana Board of Pharmacy classifies CBD oil as a schedule I substance under the Louisiana Controlled Dangerous Substance Law.
