In owning one of these breeds, one should consider the inclination to bite, but not necessarily be too scared of the breed to enjoy a healthy relationship with "man's best friend", but we should consider they are not for every home.

Just like people, there are certain situations which should possibly be avoided. Especially when small children are part of the family.

I mention this because recently a friend of mine was forced to suffer a tragic loss to his family.

While, an unavoidable situation brought on his loss, his family was nonetheless devastated to face the reality that his dog was a biter and would need to be put down.

On the website, carlsonattorneys.com, Texas law regarding dog bites is painfully simple:

Texas is a negligence, or one-bite-rule, state when it comes to dog bites. In order to recover damages, an injured person must show negligence on behalf of the dog owner.

On the site, mahonefirm.com, we learn that Louisiana law is pretty much the same in regards to dog bites:

Louisiana has established that any injuries caused by a dog are the liability of the dog owner. The dog owner also has a duty to protect the public from their dog if it is known to bite. Civil Code article 2321 has established that “the owner of an animal is answerable for the damages caused by that animal”.

Though no one ever sued my friend, the potential for his liability in regards to the family pet was obvious and the dog had certainly proven to be a danger.

The American Veterinary Medical Association wrote on their website that more than 4.5 million people are bitten by dogs each year in the United States.

The Centers for Disease Control provides further details on those dog bites:

  • Almost 1 in 5 people bitten by dogs require medical attention.
  • Children are the most common victims of dog bites and are far more likely to be severely injured.
  • Most dog bites affecting young children occur during everyday activities and while interacting with familiar dogs.

Having watched this family endure this tragedy got me to wondering if this dog's particular breed was more prone to bite than others.
