Congressman John Fleming, M.D. commented on President Obama's announcement that Merrick Garland is his pick to replace Justice Antonin Scalia on the U.S. Supreme Court. Fleming says that Garland, who currently serves as the top judge on the D.C. Circuit Court, is, most of all, a threat to the 2nd Amendment freedoms of Americans:

"Clearly the Senate made a good choice by announcing it wouldn’t move forward with any Obama nominee to the High Court. Garland’s record on the EPA and the 2nd amendment demonstrate what liberals in black robes are eager to do – rewrite the Constitution from the bench. In 2007 Garland tried to inflict one of the most restrictive gun laws in the country, ignoring the Second Amendment rights for residents of the District of Columbia. We need to replace Scalia with someone who understands and respects the functions of the High Court, and most importantly, consistently upholds the U.S. Constitution.

“I fully support the decision of my colleagues in the Senate to exercise their constitutional role of “advice and consent” and delay any hearings on any of the President’s Supreme Court nominees until 2017. Scalia’s replacement should be made by the next President of the United States, making it the people’s choice and not complicit with an outgoing President’s political agenda. Coincidentally, it wasn’t long ago that then Delaware Senator Joe Biden, now Vice President, also argued that any Supreme Court nomination should wait until after an upcoming-election."
