WAFB in Baton Rouge reports the owner of the store where Alton Sterling was shot and killed has filed suit against the City of Baton Rouge and police officers investigating the fatal shooting. The suit was filed by Abdullah Muflahi with the 19th Judicial District Court.

Muflahi is the owner of the Triple S Mart on N. Foster Drive, He is suing the officers involved in the shooting, Blane Salamoni and Howie Lake; BRPD Police Chief Carl Dabadie; the City of Baton Rouge as well as two other BRPD officers, Timothy Ballard and Robert Cook.

Muflahi saw the killing of  37-year-old Alton Sterling, He went outside his store when officers pulled up. He adds that Sterling had permission to sell CDs outside his store.

Muflahi saw the officers use a taser on Sterling before tackling him to the grown and shooting him several times. Muflahi used his own cell phone to record the incident.  The store owner says he was held in the back of a patrol car for four hours and this was clearly a violation of his rights since he was only a witness to the incident and committed no crimes.

Muflahi also maintains that officers illegally seized his security system and his cell phone without a warrant.

The investigation into Sterling's death has been handed over to the Feds. BR DA Hillar Moore has recused himself from the case and will ask State Attorney General Jeff Landry to take over the case or bring in a special prosecutor.
